From excerpts published on ChicagoTribune.com: A federal district court judge ruled on Wednesday that a lawsuit initiated by a former Lincolnwood firefighter can move forward, although the claim against the Village of Lincolnwood has been dismissed. The case was originally filed by Joshua Weller's lawyer, Daniel Zemans, in the U.S. District Court for the Northern District of Illinois, Eastern Division, on August 30, 2017. Weller accused Paramedic Services of Illinois Inc. (PSI) of fostering a discriminatory environment against a female colleague during his tenure as a firefighter/paramedic in Lincolnwood. Following this, both the Village of Lincolnwood and PSI, along with "Jane and John Does 1-10," moved to have the lawsuit dismissed. In January, Zemans requested to withdraw the claims against the village while continuing the suit against PSI. In his recent ruling, Judge Charles Kocoras granted the request to dismiss the count against the village without prejudice. He also dismissed one count against PSI but refused to dismiss six other counts. According to the complaint, after Weller confronted the discriminatory behavior and reported a supervisor's substance abuse, male colleagues and supervisors retaliated by harassing him, eventually leading to his termination. The judge noted in his decision that Weller's allegations of gender discrimination were adequately stated, especially given the "lascivious, hostile atmosphere" described in the complaint. However, Kocoras dismissed one count against PSI related to intentional infliction of emotional distress without prejudice, as the alleged harassment appeared to be more personal than professional. Weller’s legal papers state he began working for PSI in October 2010 and was assigned to Lincolnwood in December 2015. He continued there until being fired the following July. As a municipality that outsources firefighting services, Lincolnwood claims this arrangement reduces costs associated with pensions and employee benefits. The lawsuit details how male coworkers allegedly subjected their female colleague to derogatory language, labeling her "useless," and making inappropriate comments about her appearance. They also accused her of trying to seduce coworkers and questioned whether she was involved in sexual relationships with others. Meanwhile, Weller himself was labeled as the woman's protector or rumored lover, receiving inquiries about his private life and even being sent explicit messages comparing him to the individuals involved. This situation highlights ongoing issues within the fire department and raises concerns over workplace culture in outsourced environments like Lincolnwood. If left unresolved, these dynamics could further undermine trust and cooperation among staff members, impacting service delivery and community relations.
